Constitutional Challenge to Anti-nudity law

An Ontario man, Brian Coldin, is on trial for public nudity, and his lawyer, Clayton Ruby, intends to challenge the constitutionality of Canada's anti-nudity law. This is a very exciting moment and, if he is successful, it could be a watershed moment for NIFTY and clothing-optional rights all across the land. Watch this space for updates!

Good News: Interesting Nova Scotia directive

Canada's anti-nudity law, Criminal Code section 174, is unusual in that, although it is a federal law, charges under the law can only proceed with the consent of the Attorney General of the province in which the alleged nudity took place. In light of that, here is an interesting excerpt from the Nova Scotia Public Prosecution Service's DPP (Director of Public Prosecutions) Directive, last updated July 1, 2002:
“In exercising the discretion granted in Section 174, the DPP must also be guided by the jurisprudence relating to charges of public nudity, and precedents in Nova Scotia and elsewhere involving the exercise of this discretion. Those precedents clearly demonstrate that the DPP should show great restraint in the granting of consent to proceeding under these provisions. Generally, citizens ought not to face the serious sanction of a criminal conviction unless the alleged conduct amounts to aggressive exhibitionism.
The principles emerging from jurisprudence and precedents which are pertinent to the granting or denial of consent by the DPP may be summarized as follows:
a) consent will usually not be granted when the nudity occurs at an isolated or secluded location;
b) consent will usually not be granted unless a warning has been given to the alleged offender by police or an authorized enforcement agency, and there is blatant or repeated disregard of such a warning..." (NIFTY emphasis)

This would seem to suggest that, at least in Nova Scotia, getting naked is probably OK and, if in doubt, you could just try it, and put clothes on if police challenge you (assuming, of course, you aren't in the mood to get arrested, and fight the legitimacy of the anti-nude law in the courts! For more on that, see the next news item above.)
That seems like progress to us!
